2. Purchase and registration of the service
2.1. The Buyer may purchase the Services on the Service Provider's website www.einsteins.lv (hereinafter - the Website), with pre-registration and limited services without prior registration.
2.2. The personal profile with the virtual account (hereinafter - the Profile) is automatically created on the Website for the registered user, which will be used to pay for the Service. To activate the Profile, the Buyer must confirm the registration and change the password via the e-mail address provided by him/her.
2.3. The Buyer without pre-registration can purchase the gift card by providing his/her personal data. The person needs to register on the Website to redeem the gift card, where by entering the gift card code, the registered user's virtual wallet is automatically replenished in the amount indicated on the gift card. The minimum gift card amount is 20 (twenty) EUR.
2.5. After filling in the Profile registration on the Website, it is considered that the Buyer has agreed to the terms of the agreement and the distance agreement between the Buyer and the Service Provider enters into force, which can be reviewed and downloaded by the Buyer in the Profile.
2.6. The Buyer must make a deposit to his/her Profile virtual account with the Buyer's card, Internet banking or the credit from JSC “Citadele Bank” to reserve and receive services. After the deposit is made by the buyer, the Profile virtual account is automatically replenished in the amount made by the buyer.
2.7. The Buyer shall use his/her Profile to book driving training, indicating the desired instructor, date and time of the Service Provider. The several instructors of the Service Provider with different costs of the Service are available to the Buyer. The Buyer's Profile virtual account must have funds equal to the cost of the selected instructor for the selected number of hours to complete the booking of driving training.
2.8. The Buyer has the opportunity to replenish his/her Profile virtual account using the credit of JSC “Citadele banka” (hereinafter - the Credit). The Buyer can find the Application for Credit at the Profile virtual account replenishment functions. When the buyer selects the amount of the virtual account replenishment and fills in the application form of JSC “Citadele banka”, the creditors' options are automatically offered. Upon approval of any of the offered creditors, the virtual account of the Buyer's Profile is automatically replenished in the amount of the Loan specified by the Buyer.
3. Service prices and payment procedure
3.1. The prices of the Services are indicated on the Service Provider's website in EUR, including value added tax.
3.2. The Service Provider is entitled to change the prices of the service without prior notice, as well as to set special prices and discounts for the services;
3.3. The Buyer may replenish his virtual account only with the payment methods specified in the Service purchase form on the Website.
3.4. The service purchase documents are available to the registered Buyer in the Profile, and to the unregistered Buyer they will be sent electronically to the e-mail address specified in the order form.
3.5. Profile registration and maintenance is free. After registration on the Website, the Buyer must deposit a minimum amount of EUR 40 (forty) into his/her Profile Virtual Account.
3.6. Payment for the service, except for the purchase of the gift card, must be made through the Buyer's Profile. If the virtual account has less funds than the cost of the selected Service, the reservation and purchase of the Service is denied.
3.7. When the Buyer purchases or reserves the Service, payment for the Service is automatically made from the virtual account of the Buyer's Profile.
3.8. The Buyer can access and overview his virtual account through the Website by logging in to his Profile.
4. Execution of the service order
4.1. The processing of the Service order takes place only if the Buyer's virtual account has sufficient funds to purchase the selected Service. The service order will be processed within 1 working day from the receipt of the payment, if it is received on working day before 12:00. On Saturdays, Sundays and public holidays, service orders are considered received on the next working day. In some cases, there may be a delay in processing orders, but they will be processed as soon as possible.
4.2. When ordering the Service, the Buyer chooses:
4.2.2. the city of Service provision or during the Covid-19 pandemic restrictions - distance learning;
4.2.3. the category offered by the service provider - category A, category B, category BE, category C, category CE, code 95, category D, category AM or first aid, as well as additional services - medical certificate, training on credit and CSDD textbooks;
4.2.3. the group indicating the start date and times of the Service.
4.3. The service provider provides the service in accordance with the order made by the Buyer.
4.4. The Service Provider shall not be liable for any delay in the performance or non-performance of the obligations, or any other type of non-performance due to circumstances and obstacles beyond the reasonable control of the Seller. In the event of such force majeure, the Service Provider will endeavour to eliminate the delays as soon as possible.
5. Rights and obligations of the Buyer
5.5. The Buyer is entitled to refuse the booked driving training 24 (twenty four) hours prior to receipt of the planned Service. After the cancellation of reservation, the funds paid for the specific Service are automatically returned to the Buyer's virtual account. If the driving training reservation is cancelled less than 24 (twenty four) hours prior to receipt of the Service, the amount paid for the specific Service will not be refunded.
5.6. The buyer is entitled to refuse the booked first aid course, giving 2 (two) working days' notice. After the cancellation of reservation, the funds paid for the specific Service are automatically returned to the Buyer's virtual account. If the first aid course reservation is cancelled less than 2 (two) days prior to receipt of the Service, the amount paid for the specific Service will not be refunded.
5.7. In case the Buyer wants to return funds from his/her Profile virtual account, the Buyer must fill in the application on funds return (hereinafter - the Application). The application form is available in the Buyer's Profile. The completed application form must be sent to the e-mail address of the Service Provider: firstname.lastname@example.org.
5.8. In case the Buyer wants to return funds from his/her Profile virtual account, replenished with the Credit, the Buyer fills in the Application and sends it to the e-mail address of the Service Provider: email@example.com. The unused Credit amount will be returned to the bank account specified by the Buyer. The Buyer is responsible for the payment of the Loan to JSC “Citadele banka”.
6. Rights and obligations of the Service provider
6.1. The Service Provider shall include the Buyer in the training group, register in the CSDD database, inform about the procedure for obtaining a driving license of the relevant category, about the training schedule or changes in the schedule of theoretical subjects, as well as about changes in the contract prices or regulatory enactments which specify the procedure for obtaining the qualification of the driver of the vehicle.
6.2. The service provider organizes the first aid course and invites the first aid instructor to provide this service.
6.3. After successfully passing the Service Provider's theory exam, the Service Provider shall inform the CSDD thereof electronically.
6.4. After successfully passing the Service Provider's driving test, the Service Provider electronically registers the acquired lessons and informs CSDD thereof.
6.5. In case of unforeseen and important circumstances, the Service Provider may temporarily suspend the operation of the Website without prior notice to the Buyer.
6.7. To review the Application on funds return from the Buyer's virtual account within 7 (seven) days from the date of receipt of the Application and to pay back funds to the bank account specified by the Buyer within 14 (fourteen) days after the decision to return the funds.
6.8. When returning the funds to the Buyer, the Service Provider is entitled to deduct accounting costs of the payment to the Buyer in the amount of 3 (three) EUR.
6.9. to contact the Buyer by phone or e-mail address provided by the Buyer in case of incomplete registration of the Profile, to provide the necessary support to complete the registration.
6.10. To keep personal data entered during Profile registration to provide the necessary support for successful registration.
7. Right of withdrawal
7.1. The buyer is entitled to exercise the right of withdrawal within 14 days from the date of the contract conclusion in accordance with regulatory enactments. The Buyer must immediately inform the Service Provider of the exercise of this right by sending a written application to the Service Provider's e-mail address: firstname.lastname@example.org;
7.2. In accordance with the regulatory enactments of the Republic of Latvia, the buyer may not refuse the fully provided service if the provision of the service has been initiated with the express consent of the buyer and the Service Provider has received confirmation of the loss of the right of withdrawal. The Buyer may refuse the service, the provision of which is not completed, if the period of the right of withdrawal is initiated with the express consent of the buyer, but in this case the Buyer must pay a proportionate fee for the service received during the right of withdrawal.
