CONTRACT 

for driving training 

1. CONTRACT SUBJECT 

 

The Driving school ensures training necessary to receive a driver's licence of category, chosen by Trainee, at the Road Traffic Safety Directorate (hereinafter referred to as the CSDD) in accordance with the April 13, 2010 Cabinet of Ministers of the Republic of Latvia Regulations No. 358 "On training for receipt of vehicle driver's licence and programmes of vehicle drivers' training" (hereinafter referred to as the Cabinet Regulations No. 358).

2. RIGHTS AND OBLIGATIONS OF THE DRIVING SCHOOL

 

2.1. The Driving school provides the Trainee with a practical training instructor (hereinafter referred to as the Instructor) organizing and conducting training in accordance with Cabinet Regulations No. 358 and/or other regulatory enactments, if such come into force during the training.

2.2. The Driving school undertakes to process the Trainee's personal data, observing the requirements of confidentiality and ensuring the security of the Trainee's personal data.

2.3. The Driving school informs the Trainee about the changes in the prices of services specified in the Contract or in the regulatory enactments which determine the procedure for obtaining the qualification of driver of a vehicle.

2.4. Instructors, with whom the Driving school has a cooperation agreement, electronically register each driving lesson in Road Traffic Safety Directorate (CSDD) data base. Guided by the Cabinet Regulations No. 358, after the end date of driving training registration in the CSDD database, it is not possible to electronically register driving lessons in the database.

2.5. If the Trainee receives Category B practical training, the Driving school organizes a school driving test.

2.6. After successfully completing the driving training for category B or after successfully passing the Driving School driving exam, the Driving School electronically informs CSDD about that.

2.7. The Driving school shall be entitled to contact the Trainee using the contact information provided in the application form.

3. RIGHTS AND OBLIGATIONS OF THE TRAINEE

3.1. The Trainee agrees that the Driving school uses the personal data submitted by the Trainee to fulfill and ensure the obligations specified in this contract, to receive reminders, to receive information about the services of the Driving school, in addition to that, the Trainee agrees that the Driving school transfers the Trainee's personal data (name, surname, personal identification number, contact information) to the Driving school's cooperation partner for the provision and registration of the First Aid training course and Driver's medical commisionThe Trainee is responsible for the accuracy of the information provided.

3.2. By approving the contract, the Trainee agrees that for quality control and security purposes, the Driving School's driving test may be recorded in audio and video format.

3.3. The Trainee undertakes the following:

3.3.1. to inform the Driving school about the choice of the Instructor or change of the Instructor by sending this information to the electronic mail address: einsteins@einsteins.lv;

3.3.2. to acquire the necessary skills for driving a vehicle in the training area and in road traffic, in accordance with the requirements of the training programme (the number of training lessons, taking into account the knowledge of the Trainee, shall be determined by the Instructor, but the amount thereof may not be less than the minimum number of academic lessons prescribed by the Cabinet Regulations No. 358 for the relevant category). According to the skills and abilities of the Trainee, the Instructor decides on the need for additional practical lessons;

3.3.3. to pay the fee for the use of the training area at his or her own expense, in accordance with

the payment procedure specified in the training area, if such fee for the use is applied in the selected training area;

3.3.4. the frequency of use of the training area is determined by the Instructor, based on the Trainee skills and readiness for driving training in road traffic;

3.3.5. If the Trainee acquires practical training of Category B, within 3 (three) working days, Trainee must apply for Driving School exam and take the Driving School exam within 2 (two) weeks, counting from the day when the Instructor has assigned the Trainee to for arrangement;

3.3.6. after successfully completing the Driving School driving training or after successfully passing the Driving School driving test, the Trainee, within 2 (two) working days, registers to take the driving test at the CSDD. If the Trainee does not register to take the the driving test at CSDD within the specified period, the Driving School has the right to cancel the completion of driving training and the school driving exam must be taken again;

3.3.7. until the CSDD driving test, the Driving School recomends attending additional driving lessons, which increases the possibility to successfully pass the CSDD driving exam on the first time;

3.3.8. if there ir 1 (one) week until the day of the CSDD driving test, the Driving School recomends attend for at least 2 (two) academic hours or 1 (one) driving lesson. If there is 2 (two) weeks until the day of the CSDD driving test, the Driving School recomends attend for at least 4 (four) academic hours or 2 (two) driving lessons;

3.3.9. to treat the Driving school equipment with care, to compensate the damage in case of such being incurred;

3.3.10. to pay for all services related to the training within the specified time limits by transferring the tuition fee to the current account specified by the Driving school, in accordance with the provisions of this Contract.

3.3.11. to pass the driving license examinations at the Road Traffic Safety Directorate (CSDD) within three years, counting from the day of registration in the driving school study group.

4. SETTLEMENT PROCEDURE

4.1. The fee for one lesson of practical training (45 minutes) is determined according to the instructor and training vehicle chosen by the Trainee, with whom the Driving school has a cooperation agreement. 

4.2. The Trainee chooses the Instructor on the electronic platform of the Driving school. If the Trainee chooses an instructor with a higher tuition fee, the Trainee will pay the difference. 

4.3. The Trainee pays the deposit for the practical training on the electronic platform of the Driving school by bank transfer before receiving the service.

4.4. A gift card can be used as a non-cash means of payment, which covers partial or full payment for the selected services, depending on the amount indicated on the gift card.

4.5. Fee for training registration at the CSDD constitutes EUR 20.00 (twenty euros and 00 cents).

4.6. If Trainee does not come to the applied driving lesson and has not canceled the lesson on the electronic platform 24 (twenty-four) hours before the beginning of the applied lesson, then The Trainee pays the full amount of the applied driving lesson fee. The absence to the driving lesson must be reported no later than 24 (twenty four) hours before the applied lesson. If the driving lesson is scheduled for Saturday or Sunday, then the lesson must be canceled no later than on the previous working day, fulfilling the condition for the right of refusal - 24 (twenty-four) hours before the applied lesson.

4.6.1. If the driving lesson is canceled less than 24 (twenty-four) hours before the start of the applied lesson, for reasons beyond the control of the Trainee, the Driving school has the right to assess the withholding of money.

4.7. The driving school has the right to withhold 10% (ten percent) of the canceled driving lesson fee. This part does not apply to driving lessons, which are canceled less than 24 (twenty-four) hours before the applied lesson (see part 4.6. of the Agreement).

4.8. If the Trainee acquires practical training in Category B, the Driving school driving test fee is displayed on the electronic platform before applying for the test. Duration of the exam is 60 minutes. One cannot apply for the Driving school driving exam if the person has not passed the Driving school theory exam.

4.9. The Trainee may withdraw the paid service fee only in form of a service received.

4.9.1. The commission fee for returning the money is EUR 3.00 (three euro 00 cents). The money is returned to the bank account of the payer specified in the transaction receipt. The request for a refund is processed and the money is refunded within 10 (ten) working days from the date of receipt of the request.

4.10. If the Trainee arrives at the applied practical driving lesson under the influence of alcohol or other intoxicating substances, this lesson is cancelled, but the Trainee pays the full amount of the booked and applied driving fee.

4.11. If the Trainee receives the service before the payment is made, the Driving school will issue an invoice to the Trainee. If the deadline for payment of the invoice is delayed, the Driving school will send an electronically signed warning letter to the Trainee. If the invoice is not paid within the period specified in the notice, the Driving school is entitled to transfer the Trainee's personal data to the debt collection service provider.

4.12. By paying for the driving lesson, the Trainee confirms that he/she has read and accepts the terms and conditions of the Contract.

 

5. CONTRACT TERM AND PREMATURE TERMINATION

5.1.The Contract enters into force at the moment when the Trainee pays for the selected training (driving tuition) services and is valid until the full fulfillment of the obligations of the Parties or the exclusion of the Trainee from the training process.

5.2. The Driving school terminates the Contract and excludes the Trainee due to non-performance of the Contract, and does not return the received tuition fee, in the following cases:

5.2.1. The Trainee fails to comply with provisions of Clauses 3.3.2., 3.3.3., 3.3.5, 3.3.6., 3.3.10. or 3.3.11. of the present Contract, as a result of which, registration of the Trainee is revoked/annulled;

5.2.2. The Trainee does not make any of the payments specified in this Contract within the term specified.

5.3. The Trainee may unilaterally terminate the Contract by notifying the Driving school in writing in the following cases:

5.3.1. The Driving school does not fulfill the obligations provided for in Clause 2 of this Contract;

5.3.2. reasonable reasons have occurred why the Trainee cannot fulfill the obligations specified in this Contract.

6. FINAL PROVISIONS

6.1. Each party shall indemnify, in accordance with the laws of the Republic of Latvia, the other party for the damage caused to the other party by failing to perform the obligations provided for in the Contract.

6.2. The Driving school has the right to amend or terminate the Contract only on the basis of a mutual written agreement, which shall form an integral part of the Contract.

6.3. The Contract is confirmed electronically. Disputes between the parties shall be settled through negotiations. If it is not possible to reach an agreement through negotiations, the dispute shall be submitted to the court of the Republic of Latvia in accordance with the procedures specified in the regulatory enactments of the Republic of Latvia. 

6.4. The Parties confirm that the Contract is fully understood, which is confirmed by the Trainee paying for the selected training services.
